Court Papers Say NY College Student Died After Drinking 60 Ounce Bottle of Vodka
The drinking was allegedly part of a hazing incident. Sad.

Court papers filed in connection with a New York college student’s alcohol-related death reveal he drank a 60-ounce bottle of vodka during what college officials say was the hazing of pledges at an unsanctioned fraternity.
The Times Union of Albany reported the documents were filed by two students who were expelled from the University at Albany/SUNY after 19-year-old Trevor Duffy of the Bronx died in November following a night of heavy drinking during a party held by Zeta Beta Tau members at an off-campus home.
The two students want to return to the college. They were among the 24 sanctioned by the university.
The university’s investigation concluded Duffy’s death was the result of hazing. No one has been arrested. Albany police say their investigation is continuing.
According to the documents, Duffy was told by brothers of the underground fraternity that no one ever died as a result of pledging, the newspaper reported. On Nov. 15, Duffy was forced to drink a bottle with about 60 ounces of Belvedere Vodka. He was found unconscious in a bathroom at the secret fraternity’s off-campus house and died two days later at Albany Medical Center Hospital.
While a few friends tried to revive Duffy, the brothers argued over whether to call the police for help, according to the newspaper, which cited one student’s testimony.

Hyperbole or accurate statement of fact?
If he was FORCED to drink 60 oz of Vodka, the Police have a slam-dunk case for 2nd degree murder (depraved heart) that the “forcers” knew or should have known that death was the likely result from consuming that much (presumably 100 Proof) alcohol. Section 125.25(2) New York Penal Code.
If he was “forced” (via peer-pressure) to drink the alcohol, and didn’t stop because he was being encouraged to drink, that isn’t actually a crime. Neither would it have been a crime if the fratboys had left him on the bathroom floor to die right then and there (see “no duty to rescue rule” that says that, if you were not responsible for placing someone in danger or risk, you have no obligation to help them even when it would cost little to save their life). The corollary to that is if one had attempted to render aid, and then left, giving the impression that aid had arrived, but we have not evidence of that here.
