A rape linked with Greek life has led to the suspension of a fraternity at Duke.

Warrants: Phone records associate fraternity members with Duke rape case

Search warrants released Thursday indicate how investigators are piecing together a second-degree rape case involving a Duke University student who reported being assaulted after attending an off-campus party earlier this month.

While attending a Jan. 9 party at a West Chapel Hill Street home leased by members of Alpha Delta Phi Fraternity, the alleged victim said she drank a drink named “hot chocolate.”

“When she drank it, she said it did not taste like it had any alcohol in it so she thought she was safe,” the warrants said. “The last thing she remembered was dancing with her friends before she woke up the next afternoon with a t-shirt she did not recognize, no bra and no underwear.”

The leggings she wore, which were on the ground next to her bed, appeared to be torn, the warrants said.

The student then went to Duke University Hospital to complete a rape kit, which showed sexual activity, the warrants said. The woman said she does not remember having sex.

One fraternity member was alone in the alleged victim’s room for 30 minutes, the documents said.

Investigators reviewed phone records of the student and several fraternity members, including a text asking one if another needed help getting to her dorm. The student’s phone pinged on Chapel Hill Road, the location of her dorm, and South LaSalle Street, where a fraternity member lives, the warrants said.

The student told investigators she does not know anyone who lives on South LaSalle Street, nor does she remember being in that area Jan 9.

Investigators seized electronic items from the South LaSalle Street home, including a cellphone that showed texts between two fraternity members regarding the student.

In total, cellphones were collected from three fraternity members, two of whom also submitted DNA samples, the warrants said. A person “rushing” to join the fraternity also had his cellphone and DNA sample taken.

WRAL has not listed the names of those named in the search warrants because they have not been charged with a crime.

No arrests have been made as of Thursday. The fraternity has been placed under interim suspension by the school.
